PREAMBLE

 

The following previsions establish the general terms and conditions concerning the sale of the products proposed ON PARLE DE VOUS on the following website: www.onparledevous.fr. Please read these terms carefully before clicking on the “I Agree” icon. Agreeing to the present terms and conditions implies that they have been read and accepted by you, the Customer. If you do not agree to these terms and conditions, do not click on the “I Agree" icon and do not use this service. Clicking on the “Confirm Order” icon implies that you have confirmed your order. All confirmed sales' orders are final.

ON PARLE DE VOUS advises customers to carefully read the following terms and conditions. ON PARLE DE VOUS reminds its customers that it is not possible to place an order without first having accepted these terms and conditions.

ON PARLE DE VOUS is a private limited company registered at, and operating from, the following address: 111 boulevard de Sebastopol 75002 Paris, France. ON PARLE DE VOUS is registered with the French Trade Register (Company Number: 432 539 260, Capital: 32 000 €). 

ON PARLE DE VOUS reserves the right to modify the present terms and conditions. Any modifications will be made known to the customer on the first page of the ‘My Account’ area. Customer's not wishing the present contractual relationship to be overruled by the new terms and conditions must make it know to ON PARLE DE VOUS, and from the effective introduction date, those customers must not use the services provided by ON PARLE DE VOUS. In the event whereby any one of the provisions of the terms and conditions is considered illegal or non-invocable by a court decision, all the other previsions remain in force.

 

 

 

 

ARTICLE 1 • PURPOSE

The following terms and conditions aim to define the relationship of E-TREND and its users as established via the Internet, the mutual rights and obligations of the two parties, as well as the different stages of the ordering process. 
Order placement is restricted to adults over 18 years old, and people under 18 years old with formal consent from a parent or legal guardian. 

 

 

 

ARTICLE 2 • PRODUCTS

All products present on the onparledevous.fr website are considered available for sale for the duration of 1 week starting from the first day of online sale. All products are subject to stock availability. ON PARLE DE VOUS will rapidly notify its customers in the event of a product being unavailable.

If a product has been ordered and paid for, and remains unavailable for over thirty days (30 days) following the confirmed order date, the customer will be informed by e-mail. ON PARLE DE VOUS will then proceed to refund the customer the total paid amount. Please note that all available products of the order will be delivered as agreed.

The products offered for sale are those featured on the Site. ON PARLE DE VOUS makes every effort to accurately present and describe the products, subject to technical constraints and in accordance with the highest standards on the market.  It is, however, possible that the Site may contain minor errors, which you recognize and accept. In the event of any non-compliance of the product delivered with its description on the Site ON PARLE DE VOUS agrees to remedy such non-compliance: you may either exercise your right of cancellation, or else implement our warranty of merchantability.


All images and texts illustrating our products are non-contractual.

 

 

 

 

ARTICLE 3 • PRICES 

The prices displayed on the Site are in Euros (France-International all taxes included, not including the processing and shipping fees.

The prices invoiced to customers include VAT and potential discounts applicable on the date of the order.
Any new taxes or contributions, notably environmental, may be added to the retail price of the Items.

ON PARLE DE VOUS reserves the right to modify the prices of Items at any time, the Items being invoiced based on the rates in effect at the time of the validation of each Order.

The items remain the full property of ON PARLE DE VOUS until complete payment of the price, which the customer recognizes and accepts.

 

 

ARTICLE 4 • ORDERING AND PAYMENT

 

• 4.1 PLACING AN ORDER

Customers interested in any product available for purchase on monshowroom.com can place their order directly on the website www.onparledevous.fr. 
Customers paying directly on the ON PARLE DE VOUS website must observe the following procedure :

For the customer's first order with ON PARLE DE VOUS, the customer must fill in a mandatory online form requesting the following information: title, first name, surname, complete delivery address, e-mail, and telephone number. A delivery preference will also be asked for.

The Customer chooses his/her desired product(s) by clicking on the link "Add to shopping bag".

 

The customer can at any time:

Review his/her selected products by clicking on the link "Add to Shopping Bag"

Continue shopping by clicking on the link "Continue Shopping"

Finish shopping and place an order by clicking on the link "Proceed to checkout"

 

To order the selected products the customer must identify him/herself by providing his/her e-mail and creating a password. The Customer will be sent an automatic confirmation email. The customer accepts that the provided information (e-mail and password) is proof of identity and is a valid expression of the customer's consent. 

If the customer does not possess an account, he/she must fill in the mandatory form which will appear during order placement. The customer can also fill in the form before placing an order via "My Account", then clicking on the link "Create my account".

Once the customer has been identified, he/she will be required to confirm the given delivery address. An order summary will then appear stating the following: the type, the quantity and the price of the product(s) selected by the customer; as well as the method of payment, the customer's contact information and the given delivery address.
The Customer declares being at least 18 years old and having full legal capacity or if he/she is a minor, guarantees having parental permission to place his/her Order.

 

 

• 4.2 ORDER VALIDATION

The payment of the Order requires the acceptance of these Terms of Conditions, the price of the Items and the content of the Order.

Once the customer is satisfied with the order, and has provided the required mandatory information, he/she can then click on "Confirm" to finalise the order. Following confirmation of the method of payment, the customer confirms definitively and unconditionally the order placement.

The customer will be required (Payment by credit card):
To confirm his/her address, the product(s) and the total sum.
To give his/her bank card number and its expiry date as well as the security code number (the 3 figured number at the back of the bank card).

In any event, whichever method of payment the customer chooses, ON PARLE DE VOUS acknowledges the placement of the order as soon as confirmation by e-mail, or by any other desired means has been given to the customer, according to measures outlined under French law in article L121-19 of the French Consumer Rights Act.

In the framework of our validation procedure of a customer account, please note that ON PARLE DE VOUS can ask a customer to produce a photocopy of his/her identity card or passport, as well as proof of address, e.g. an electricity bill. On waiting receipt of the required documents the order is considered as "in validation". ON PARLE DE VOUS asks their customers to provide the documents within 7 days of the initial demand in order to guarantee rapid order processing. Failure to do so will lead to the automatic cancellation of your order.

By validating the order the customer declares to be 18 years old or above, or to have obtained formal consent from a parent or legal guardian to place an order on the ON PARLE DE VOUS website. Customers less than 18 years old, having first obtained formal consent from a parent or legal guardian, are under the obligation to inform the parent or legal guardian of all data communicated during the order process; the latter retains the right to contest the archiving of this data and/or their transmission to a third party.

The modification or cancellation of an order is not possible if the order is already transmitted to our logistic department.

In case of fraudulent use of their credit card on the Website, or if the Customer does not receive an email following his/her Order, the Customer must contact ON PARLE DE VOUS customer service at the following number: +33(0)1 42 21 96 62 (Tuesday to Friday, from 10am to 12pm and 2pm to 5pm) or by email via the contact form located on the contact page of the website.

ON PARLE DE VOUS cannot in any case be held responsible in the event of an input error or transmission of an input error not allowing the issuance of the confirmation email and/or Items.

It is recommended that the Customer keep a copy of the Order confirmation email.

For any question regarding the tracking of the Order, the Customer must contact customer service by filling out the contact form located on the contact page of the website. 

 

• 4.3 PAYMENT

The amount owed by the customer is the total sum stated on the order summary sent to the customer by e-mail. Payment by bank card (Visa, Eurocard/Mastercard) is debited immediately from the customer’s bank account via a secure online payment platform (CYBERMUT).

ON PARLE DE VOUS reserves the right to refuse any orders and deliveries in the case of a dispute between the two parties concerning the non-payment, full or partial, of a preceding order. The same right of refusal extends to the non-authorization of payment by bank card by a banking establishment or the non-payment or partial payment. Under no circumstance can ON PARLE DE VOUS be held responsible. If the customer's credit/debit card is not denominated in Euros, the final price will be calculated in accordance with the applicable exchange rate on the day your card issuer processes the transaction.

In accordance with the clause L.134-2 of the FrenchConsumer Rights Act, for any sum over one hundred and twenty (120) euros, ON PARLE DE VOUS will hold records of the proof of sale in paper form or electronically, and this for the legal duration allowed for by the said governing laws. The customer retains the right of access to this document at any time by written demand accompanied by proof of identity.

 


• 4.4ORDER ARCHIVES

The order confirmation is recorded in the books of ON PARLE DE VOUS, stored in a reliable and sustainable area. The Customer agrees that confirmation of the order is seen as evidence of the contractual evidence between the Parties.

 

 

 

ARTICLE 5 • DELIVERY

Each product delivered to the customer's chosen delivery address is accompanied with a delivery receipt.

ON PARLE DE VOUS reserves the right to refuse to deliver customer orders to collective addresses, for example, offices, health care establishments, hotels, etc. If a delivery is made to a collective address, the customer accepts that the delivery obligation of ON PARLE DE VOUS has been honored on reception of the product at the address stipulated on the delivery-label. This prevision also applies in the event of a delivery not reaching the designated recipient, but by a third party.

ON PARLE DE VOUS will deliver orders with a delivery within a maximum of ten (10) business days for delivery to Metropolitan FRANCE and twenty (20) business days for delivery for any other destination counting from the day following receipt of the order.

Any order registered on the Website Monday through Thursday before 3 p.m. will be processed the same day; after 3 p.m. it will be processed the following day. All orders placed after 3 p.m. Friday, Saturday and Sunday will be processed the following Monday; it being understood that orders placed on a holiday will be processed the following business day.

Exceeding the delivery time, not justified by force majeure (Act of God), the Customer may request cancellation of the sale and obtain within a maximum period of 30 (thirty) days the refund of the amount paid in connection with the sale.

For international orders, your country may apply customs duty on this import, and you will have to pay the duty in order to get the goods.

In spite of the considered care ON PARLE DE VOUS accords to the preparation of an order it may arise that an ordered product has been mistakenly omitted from the parcel. It is also possible that a product of a compromised quality has been shipped.

Accepting the above, it is important that the customer verifies the contents of the parcel on receipt. Any anomaly detected by the customer (a missing or faulty product) should be made known to ON PARLE DE VOUS by recorded delivery to the company head office within 3 days of receiving the parcel

If the conditions outlined above have been fulfilled, ON PARLE DE VOUS will proceed to a product exchange, a voucher to the products value, a refund of the damaged product(s), or the shipment of the missing product (withholding the legitimacy of the buyer's claim)

Any claim made known to ON PARLE DE VOUS beyond this delay will be rejected and ON PARLE DE VOUS cannot be held liable. ON PARLE DE VOUS reserves the right to request that the customer return the damaged product.

Products available for sale on the website ON PARLE DE VOUS can be purchased in all European Union countries. ON PARLE DE VOUS reserves the right to modify the country distribution list at any moment.

 

 

 

ARTICLE 6 • RECEIVING ORDERS – COMPLAINTS - RETURNS

The Customer is required to verify the correctness of products received under his order at the time of delivery.

Any anomaly concerning the delivery such as:

  • Damaged packaging
  • Missing products
  • Damaged products
  • Products not complying with the order,

must be addressed within legal delay after receipt of order.

 

This notification must be sent to ON PARLE DE VOUS customer service Website:

  • By mail, write to the following address: E-boutique ON PARLE DE VOUS SARL – 111, boulevard de Sébastopol – 75002 Paris – France
  • By email via the contact form located on the contact page of the website.

 

After this time, and except for hidden defects, no claim will be accepted by ON PARLE DE VOUS. The Products are then considered correct.

For return of wrong products, the Customer must comply with the following:

  • Customers must, within a maximum period of 14 calendar days after their Order is dispatched, complete the Return Form available in the Returns and Reimbursements section of the "My Account" area of the ON PARLE DE VOUS website. Any claim filed after this deadline will not be accepted and ON PARLE DE VOUS will be released from any liability,
  • The Customer will receive a confirmation of returns by mail the completed return form beforehand printed that The Customer must attach to his package. No returns will be accepted without the aforementioned return form completed.
  • If repayment conditions are met, The Customer will also receive a freepost returns label from ON PARLE DE VOUS.  
  • Products must be returned in their original packaging, or in any package protecting the product from damage,  with labels and any accessories, in perfect condition to be sold again on the website to this address E-boutique ON PARLE DE VOUS SARL – 111, boulevard de Sébastopol – 75002 Paris.

 

Where defects have been confirmed, ON PARLE DE VOUS proposes to the Customer either:

  • Replacement of the Product(s) at the expense of ON PARLE DE VOUS or,
  • Reimbursement of the order price (price of products and delivery charges) and cost of shipping, no later than within thirty (30) days from the mailing date of notification confirmation of error by the customer service Website ON PARLE DE VOUS.
  • Please note that if you return the goods www.onparledevous.fr we will issue with a full refund for the cost of goods less any import duties or taxes.

 The returns cash on delivery (COD) are not accepted.

If the Customer does not receive an email following his/her Order/Returns, the Customer must contact ON PARLE DE VOUS customer service at the following number: +33(0)1 42 21 96 62 (Tuesday through Friday, from 10am to 12pm and 2pm to 5pm) or by email via the contact form located on the contact page of the website. In case of abnormal or abusive claims, ON PARLE DE VOUS may refuse to serve later orders. Any non-compliant return (not containing the return slip) shall be rejected and ON PARLE DE VOUS will be released from any liability.

 

 

 

ARTICLE 7 • RIGHT OF RETURN (COOLING-OFF PERIOD)

The customer has a period of fourteen (14) days from the date of receipt of his order to return the Products ordered, with no explanation or penalty.

 

For returns under the right of withdrawal, the procedure below must be fully respected:

  • Customers must, within a maximum period of 14 calendar days after their Order is dispatched, complete the Return Form available in the Returns and Reimbursements section of the "My Account" area of the ON PARLE DE VOUS website. Any claim filed after this deadline will not be accepted and ON PARLE DE VOUS will be released from any liability,
  • The Customer will receive a confirmation of returns by mail the completed return form beforehand printed that The Customer must attach to his package. No returns will be accepted without the aforementioned return form completed.
  • If repayment conditions are met, The Customer will also receive a freepost returns label from ON PARLE DE VOUS.

Subject to the conditions mentioned above, ON PARLE DE VOUS will refund the amount of all taxes included in the order to the Customer. The bank account of the Customer will be credited to such amount within thirty (30) days of receipt of the Products by ON PARLE DE VOUS.

 

 

 

 

 

ARTICLE 8 • PRIVACY POLICY

ON PARLE DE VOUS collects certain information necessary to process orders.

Such data is not only necessary to process the customer’s order by ON PARLE DE VOUS; but also to provide the Customer with information about the brand ON PARLE DE VOUS on the Website or with ON PARLE DE VOUS product offers, if the Customer accepts it while validating his order.

Information is strictly confidential and is listed with an asterisk (*) when necessary to THE OTHER STORE, and/or its contractors as part of the management of the customer order.

Following any injunction or legal authorities to defend the rights or those of its employees, customers or anyone else, ON PARLE DE VOUS may provide your information to agencies and authorities legally authorized.

 

ON PARLE DE VOUS agrees to take every precaution to ensure the security of its files and protect its computer system, and prevent personal information such as the Customer’s from being distorted, corrupted or available by unauthorized parties.

 

The Customer’s personal information is sent to and stored by the hosting company located in France, whose coordinates appear on the Website under the heading “Legal”. Under the Data Freedom and Protection Act of January 6, 1978, as amended by the Act of August 6, 2004, the Customer has the right of access, rectification, modification, and deletion of data.

According to the French law " Informatiques et Libertés " n° 78-17, from 6 January 1978, as modified by the French law from 6 August 2004, you have a right of access, rectification, and opposition to your nominative data.

 

The Website is registered with the National Commission for Computing and Liberties –CNL under the number 1351361.

ARTICLE 9 • INTELLECTUAL PROPERTY 

All the website's components:  visual or audio, and the underlying technology, are protected by copyright, brand and patent laws. 

They are the exclusive property of ON PARLE DE VOUS. Any user owning his/her own Internet site, and wishing, for personal use, to include a hyperlink to the monshowroom.com homepage, on his/her site, is under the legal obligation to ask authorisation from ON PARLE DE VOUS.

 

However, hyperlinks leading to the onparledevous.fr website using the framing technique or the in-line linking are strictly and formally forbidden.
In any event, any link, even having been tacitly authorised, must be taken down at ON PARLE DE VOUS's request.

 

Hyperlinks can route to sites other than the onparledevous.fr site. ON PARLE DE VOUS declines all responsibility in the event whereby that site's content contravenes current governing rules and laws.

 

 

 

 

 

ARTICLE 10 • COOKIES

To process the customer order, and in order to better understand their needs and customize the services offered on the Site, ON PARLE DE VOUS uses cookies. A cookie is a file stored on the hard disk of the Customer PC to report that his visit to the site.

Cookies memorize the time spent by the Customer on the Site, his identity (his email address and password) and the contents of his basket. Once disconnected from the Site, this information is stored for 30 (thirty) days before being permanently deleted.

Customer may oppose the registration of cookies by configuring their browser. They lose any customization of the service that is offered on the Site.

 

 

 

 

 

ARTICLE 11 • LIMITATION OF LIABILITY

Placing an order on the Website implies knowledge and acceptance of procedures on the Internet, including those regarding technical performance, response and connection times, questions or transfers of information, risks of contamination by viruses circulating on the network and in general all the risks associated with the use of the Internet.

 

ON PARLE DE VOUS may not therefore in any way be held liable for any direct or indirect damage resulting from misuse or incidents related to the use of computers, access to the Internet, maintenance or malfunction of the servers, the phone line or any other technical connection, connection to the Site by the Customer occurring under his full responsibility.

 

 

 

 

 

ARTICLE 12 • FORCE MAJEURE

ON PARLE DE VOUS will not be liable for the total or partial breach of its obligations in respect of the order placed by the Customer if this breach is caused by an event of force majeure as defined by positive law.

In such a case, The Other Store shall inform the Customer of the occurrence of such an event within three (3) days after it occurs, by e-mail.

After a period of 1 (one) month, and assuming that the causal event of a force majeure persists, the order will be cancelled and will, where appropriate, be subject to reimbursement of The Other Store on the credit card used for the making of the order within a maximum period of 30 (thirty) days.

 

 

 

 

 

ARTICLE 13 • APPLICABLE LAWS AND JURISDICTION

If any of the terms of these Conditions of Sale are void, illegal or made unenforceable by a court decision, the other provisions of the Terms and Conditions remain in effect.

The Terms and Conditions are executed and interpreted in accordance with French law.

In the event of any dispute, the customer shall first contact The Other Store to seek an amicable resolution and, failing an agreement, the common law courts shall have sole jurisdiction.
